Intellectual property (IP) is a valuable asset for innovators, as it helps to protect their ideas, inventions, and creations from infringement. By securing IP protection, innovators can generate revenue through security and licensing and prevent others from using or duplicating their products without permission or consent.

There are several types of IP protection available for innovators, including:

  • Patent protection: This type of protection is designed to protect inventions and provides a legal monopoly for the inventor for a specified period. During this time, no one else can produce, use, or sell the patented invention without the inventor’s permission.
  • Trademark protection: This type of protection is designed to protect the distinctive signs, such as logos and names, used to identify and distinguish a product or service from others in the marketplace.
  • Industrial designs or plant breeders’ rights: This type of protection is designed to protect the appearance of a product, including its shape, pattern, and colour, and it provides a legal monopoly for the creator for a specified period of time.

In Kenya, innovators can file their patents through the Kenya Industrial Property Institute (KIPI). If an innovator plans to patent their invention in a foreign country, they will need to make a request to KIPI to continue.

Once an innovator files for a patent, they have the right to protection against anyone who tries to claim their invention. This includes the right to sue for damages, stop others from using the invention, and receive compensation for any financial losses they may have suffered due to infringement.
